These terms govern your use of the TracFax mobile application and the TracFax service (“TracFax”, “the service”). By signing in, you agree to them. If you do not agree, do not use the service.
TracFax is supplied to organisations, not to the general public. Your employer or the organisation that issued your account holds the agreement covering the service. If anything in these terms conflicts with that agreement, that agreement governs.
Accounts are issued by your organisation. You are responsible for keeping your credentials confidential and for activity carried out under your account. Do not share your account, and tell your administrator promptly if you believe it has been used without your permission. Your organisation’s administrator can suspend or remove your access at any time.
You agree not to:
Inspections, checklists, photographs, signatures, timesheets, safety forms and comments you submit are your organisation’s business records. Your organisation controls them, decides how long they are kept, and can view them. Handling of personal information is described in the Privacy Policy.
Some features record your device’s location — clock-in and clock-out, sorting work by proximity, and stamping the location onto photographs you take for an inspection. Photographs you capture in the app may carry the place and time they were taken. Use these features only in the course of your work and in line with your organisation’s policies. You can withdraw location or camera permission in your device settings; features that depend on them will stop recording that information.
TracFax records safety documentation, including Job Hazard Analysis forms. It is a record-keeping tool. It does not assess hazards, does not make a site safe, and does not replace your training, your employer’s safety programme, your professional judgement, or any legal obligation that applies to your work. Never rely on the app to decide whether it is safe to proceed.
The service is provided as it is, without a guarantee of uninterrupted or error-free operation. It may be unavailable during maintenance or because of circumstances outside our control.
The application stores work on your device so it can be used without a network connection, and uploads it when a connection returns. Work held only on your device is not saved to the service until it uploads. If the device is lost, reset, or the application is uninstalled before that happens, that work may not be recoverable. Sync when you have a connection.
The application, the service, and everything in them other than your organisation’s data remain the property of TracFax and its licensors. You are granted a limited, non-exclusive, non-transferable right to use the application while your account is active, for your work for the organisation that issued it.
We may change, add to, or withdraw features. We may update these terms; the date at the top of this page shows when they last changed. Continuing to use the service after a change means you accept the updated terms.
Your access ends when your organisation ends it, when the agreement between us and your organisation ends, or if these terms are breached. On termination your right to use the application stops; your organisation’s records are dealt with under its agreement with us.
To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, TracFax is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost or corrupted data, arising out of or relating to your use of the service. Nothing in these terms limits liability that cannot lawfully be limited.
These terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws rules, and the courts of Hennepin County, Minnesota have exclusive jurisdiction over any dispute arising from them.
